In pursuit of justice - the somewhat shorter version - please help!!!!!

                                                                 11/29/12
A somewhat shorter (not the long) version:  Synopsis:

Some Choices Are Evil - There is the Way, Inc.- in the pursuit of justice:  (A non-profit corp. that was always inactive formed in the Commonwealth of Virginia)

Very brief synopsis:
September 4, 1996:     Three corporations are formed in the Commonwealth of Virginia in 1996, and were always inactive.
April 4, 1997:     New Jersey issues a Certificate of Authority to Some Choices Are Evil - There is the Way, Inc. dated:  April 4, 1997 (filed stamped Apr 7, 1997) as a foreign, non-profit corporation.
September 1, 1997:     All three corporations are terminated by Virginia, 9/1/1997.
Circa March/April of 2011:     Ken Miller starts thinking/planning about withdrawing/dissolving the corporations in April of 2011, not knowing about New Jersey's Minimum Corporation Tax Law, nor how tough a process it would be.
November 2011:     Visit lawyer(s) and/or angel(s) to  discuss withdrawal/dissolving all three corporations and pay all back taxes, penalties, and fees (still not knowing about the NJ Statutes talked about below, and about the U.S. Constitution, Article IV, Section 1 [Full faith and Credit Clause]), and that the corp. was a foreign, non-profit corp. that was terminated on 9/1/97, and non-profits are not liable to pay corp. taxes.
December 2011:     After reading the Notice of Termination of Corporate Existence from the Commonwealth of Virginia more closely, and after prayer, and a lot of the good Lord's grace, I discovered that because the corporation was terminated on 9/1/1997 (in the jurisdiction of its incorporation), and because of the U.S. Constitution, Article IV, Section 1, and NJ Statute Title 14A: 13-5. Effect of certificate of authority  NJ's Certificate of Authority should be null and void as of 9/1/1997, and, therefore, could not have conducted any business (it never did conduct any business anyway) and could not be liable for any taxes, penalties and fees except for the tax year of 1997.  A Certificate of Withdrawal from the State of New Jersey should be issued as soon as possible to me, dated as of 9/1/1997.
January 2012 - present:     Numerous attempts to receive justice with the NJ Div. of Taxation, and NJ Div. of Revenue - with letters seeking justice going to the NJ Div. of Taxation, NJ Div. of Revenue, NJ Dept. of the Treasury, NJ Secretary of State, NJ Attorney General, NJ Lt. Governor, NJ Governor, NJ Legislative Representatives (Assembly and State Senator), U.S. House and Senate Representatives, U.S. Attorney General,  NJ Supreme Court Justices, the Vice President, the President, and the U.S. Supreme Court Justices, but to no avail.  Still seeking justice, and Lord willing, will persevere until justice is achieved.

Dear family, friends, and all others concerned about justice,

Shouldn't we abide in Christ's Law?  Shouldn't we abide in the laws of the U.S. Constitution and the State's Constitution in which we live?  Shouldn't we also abide in the State Statutes in which we live?  I seek justice with the State of New Jersey.  Shouldn't I be protected by the U.S. Constitution, and by NJ Statutes - shouldn't they be enforced?  The U.S. Constitution, Article IV, Section 1 calls for States to give full faith and credit to the public Acts, Records, and judicial Proceedings of every other State.  The Commonwealth of Virginia (in which a corporation was formed on September 4, 1996) terminated the corporation on September 1, 1997 by operation of law.  The Notice of Termination of Corporate Existence states in part, "AMONG OTHER THINGS, THIS TERMINATION MEANS THAT THE CORPORATION CAN NO LONGER LAWFULLY CONDUCT BUSINESS AND ITS DIRECTORS ARE REQUIRED TO LIQUIDATE ITS BUSINESS AFFAIRS."  If this wasn't sufficient to invalidate NJ's Certificate of Authority to the corp. (Certificate of Authority is dated April 4, 1997, filed Apr. 7, 1997, with the Secretary of State) as of 9/1/97, then NJ Statute Title 14A: 13-5. Effect of certificate of authority specifically mentions that the corp. shall be authorized to transact [any] business and shall continue, "... so long as it retains its authority to transact such business in the jurisdiction of its incorporation ..."  The corp. ceased to exist on 9/1/97 in Virginia (the jurisdiction of its incorporation).  There are two other laws on NJs' Statutes that mention, or include the wording, "its authority or existence is otherwise terminated or cancelled in the jurisdiction of its incorporation" and they are 14A:13-9(1). Termination of existence of foreign corporation, and 14A:13-12(d). Injunction against foreign corporation.

Now the State of NJ raised the question as to the status of the corp.  Lauren Musser's letter (at the NJ Div. of Taxation) dated 9/5/12, states that the Div. of Revenue has now made the corp. a non-profit corp. (the Certificate of Authority issued by the NJ Secretary of State filed stamped it in September 0f 1997).  Am I protected by the U.S. Constitution, and by NJ Statutes, or not?  Whom should I contact to receive justice?  The NJ Div. of Taxation told me months later to send the NJ Div. of Revenue the Notice of Termination of Corporate Existence, which I did.  Whom should I contact about the lack of enforcement of NJ Statutes?  I still haven't heard back from the NJ Div. of Revenue, or from most of the "public servants" that I've contacted looking to receive justice.  I will persevere, the good Lord willing, until justice is obtained.

I am looking for the NJ Division of Revenue / NJ Div. of Taxation to refund all the money that it has collected that is in excess of all that I was liable for.  I am a poor working fellow, and the amount that the State owes me is a lot!!!

Thank you very much for all your help.  I covet your prayers!!!  Hope that you and the loved ones have a joyous and peaceful day.  May the good Lord, our Creator Lord, bless you and the loved ones with blessings upon blessings!

In hope, peace, and love,

Re: Your letter dated 9/5/12

Dear Lauren Musser,

Greetings!  I hope that you and the loved ones are in good health.  Good health is such a wonderful blessing from the good Lord, our Creator Lord!  I am very thankful to our loving, gracious, merciful Creator Lord for being able to get out of bed, and for the opportunity to write to you. Please remember that we humans are created by our Creator Lord, in His image, with inalienable rights!  I had received your letter dated 9/5/12 on 9/8/12.  Please let me when, if ever, I was advised of, or told of how, I could, or could not, appeal a NJ Div. of Taxation decision (I believe that the first that I had heard anything about an appeal was when Mr. Joseph C. Minch called [on 8/22/12] and said that he'd call me back - within two days).  Also in your first paragraph you mention "that Revenue has now made your corporation a non-profit ...  Please see a copy of the Certificate of Authority that is dated 4/4/97, and Filed stamped 4/7/97, issued by the State of New Jersey.  Was the corp. a non-profit back in 1997, or not?  In the second paragraph you state that I cannot appeal the filing of the tax returns and the tax plus penalty and interest that has been sent in thus far due to the fact that the tax returns and taxes plus penalty and interest were voluntarily sent in.  When I went to the lawyer (or was she an angel?) I was advised to do something a certain way.  I believed then, and still believed (until recently) that I was under a legal obligation to send the money in.  I can, and do, denounce Satan, and his minions, voluntarily; and I can, and do, resit the Devil voluntarily; and I can, and do, praise the good Lord, and exclaim that Jesus is Lord!, voluntarily.  The money sent in to the State of New Jersey (both the Div. of Taxation and the Div. of Revenue) was sent in not voluntarily, but because I believed that I was under a legal obligation to do so.  The corp. was terminated in the State of its incorporation (Virginia) back in 1997 (9/1/97), and by the U.S. Constitution Article IV, Section 1, and by NJ Statutes, the corp. no longer had authority to transact business in Virginia, or any other State after 9/1/97.  I am trying to clarify what the status of the corp. is with the NJ Secretary of State, and the NJ Div. of Revenue, and I believe that I will contact them again about the withdrawal, not to mention that I'll continue to pursue justice.  Does a foreign non-profit corp. have to pay taxes?  Please let me know.  I will send a copy of something regarding non-profit corps. that says that the corp. is exempt from the New Jersey corporation business tax without any exemption letter (see page entitled Nonprofit Corporations).  I will continue to seek justice.  I will continue to seek the return of excess taxes paid to the NJ Div. of Taxation, and the Div. of Revenue.  Please let me know how much was paid to the Div. of Taxation.

Thanks again for all your help.  Hope that you and the loved ones have a joyous and peaceful day.  May the good Lord, our Creator Lord, bless you and the loved ones with blessings upon blessings!!!

Sincerely,

Ken Miller
