It was way back in September of last year that Sen. Lindsey Graham, R-S.C., introduced a bill to establish a federal ban on abortion at 15 weeks gestation, with some exceptions. The bill has generated predictable controversy since then – and much of that controversy has occurred within the pro-life movement. Without disparaging the motives of Sen. Graham or other supporters of this measure, we at Life Legal stand with those who think a 15-week FEDERAL ban is a not a good idea. Indeed, it seems clear to us that the very text of the bill argues against its enactment. The bill commences with a litany of medical facts concerning prenatal development – all accurate, and all the sort of thing that abortion enthusiasts can’t stand hearing: The child in the womb first moves and reacts to touch at 8 weeks…. Eyes are completely formed by 10 weeks…. Brain waves are present by 8 to 9 weeks…. The child senses stimuli from outside the womb at 12 weeks…. Specifically human body form is present at 12 weeks…. And so on. These are the realities that pro-aborts seek to forbid mentioning on sidewalks from California to Maine. The question is: if all these markers of humanity are in place at 8 weeks, 9 weeks, 10 weeks, and 12 weeks, why would we want to draw a line at 15 weeks and consign younger babies to subhuman and unprotected status? The most ominous feature of the 15-week federal ban is the perceived purpose of the proposal: National Public Radio described it as “an attempt to force Republicans to adopt a partywide consensus on the issue….” NBC said Republicans were seeking “safer political ground….” Sen. Graham himself hoped that the bill would bring the U.S. into line with most European countries…. Consensus, safer political ground, falling into line: are these dubious concepts what the pro-life movement needs to stop the daily mass murder that constitutes legalized abortion in the United States? Whatever the motives of those who back the 15-week ban, we at Life Legal are convinced that its actual effect, if passed, will be to put at least a temporary end to widespread controversy over the issue. And the pro-life movement does not want to end controversy over abortion. We do not want abortion to become a non-issue. We do not want to settle into a nice, relaxed peace with an abortion empire that is killing thousands of children a day – just because it is generally sparing those beyond 15 weeks’ gestation. Of course, pro-lifers would never truly settle into such an arrangement. They would eventually rise to their feet once again to fight for all babies in the womb. But they would be hobbled – maybe even crippled – by the perception that the issue had been settled. That, after all, is what Roe v. Wade was intended to do. Life Legal is not opposed in principle to imperfect legislation. State heartbeat laws, informed consent laws, parental notification for minor girls: all these serve legitimate pro-life purposes – and allow for further advances in future. In our view, a 15-week federal ban would, for way too long a time, have the opposite effect.
