We’re FIGHTING RIGHT NOW to SAVE A LIFE! Please help…. As I write this, Life Legal attorneys are intervening on behalf of a young woman who stopped breathing after she had an asthma attack three weeks ago. The 31-year-old can blink and move her head in response to commands. The hospital, which is not equipped to handle brain injuries, wants to discontinue care. The young woman has not received nutrition since she was admitted to the hospital. We are representing the woman’s fiancé, who has health care power of attorney (POA). However, the hospital refuses to recognize him as the woman’s legal health care decision-maker. In effect, they are defying established procedures. Instead, they have designated the woman’s estranged mother, who lives in another state and hasn’t bothered to visit her daughter, as the health care “surrogate.” The daughter spent much of her life in foster care because of an abusive home situation. Not surprisingly, the mother has authorized the hospital to withdraw all care and treatment. Incredibly, the mother also refuses to allow the fiancé to have any contact with her daughter, so the young woman has been alone in her room for over a week without so much as a video visit. Life Legal filed a lawsuit against the hospital and the mother to restore rightful decision-making authority to the woman’s fiancé. A neurologist familiar with the situation has filed a formal complaint against the hospital. We have handled many cases involving the denial of life-sustaining care, but I have never seen a situation like this where the hospital flat out refuses to comply with a health care POA. This is not only unconscionable; it is unlawful. That a hospital believes it is immune to any kind of sanctions speaks volumes about the state of our health care system. LAST MINUTE REPRIEVE: The court just issued a court order prohibiting the hospital from removing any life-saving treatment, including respiratory support, and requiring the hospital to provide the targeted patient with nutrition! Please pray for the young woman and her fiancé, as well as Life Legal’s attorneys as we continue to fight for her life. The court has scheduled a hearing for March 11.
